Abstract in English: Abstract In the contemporary movement to revive republican political theory, little attention has been paid to Hegel’s political philosophy and the existence of a tradition of German republicanism. This article seeks to demonstrate how Hegel’s Philosophy of Right supports a republican political conception that is an alternative to liberalism in three fundamental aspects: (a the recognition of the importance of civic virtues as an integrating foundation of the community; (b the critique of the liberal conception of the separation between the state and civil society; (c the conception of freedom in the republican sense of “non-domination”. It concludes that Hegel’s Philosophy of Right constitutes an attempt to update republican thought to the conditions of domination arising from the dynamics of modern civil society. |

Artigos inéditos Contributions to a Marxist analysis of public policies: the materialization process of the Primary Health Care policy in Brazil Couto, Joaquim Gabriel de Andrade Mendes, Áquilas Abstract in Portuguese: Resumo Este artigo busca apresentar contribuições para uma análise crítica marxista das políticas públicas, tendo como objeto de estudo a Política Nacional de Atenção Básica (PNAB) brasileira. Abstract in English: Abstract This article aims to present contributions to a Marxist critical analysis of public policies, having as its object of study the Brazilian National Primary Health Care Policy (PNAB). For this purpose, it uses the Marxist theoretical framework developed by two Argentine social scientists, Bonnet and Huwiler, whose starting point is the social relations that compose the totality of the capitalist mode of production. In this sense, it points out that the development process of a public policy occurs through a trial and error mechanism, which is configured as a process of constant adaptation to the limits imposed by the necessity of reproducing capitalist social relations. Thus, the juridical-institutional materialization of PNAB in 2006 is presented as a process that crystallizes a previous adaptive movement, initiated in the mid-1970s with the concept of primary health care and whose adaptation developed in the following decades. This adaptation process is a reflection of the historical movement of capitalist social relations of production, in such a way that public policies are always responses from the capitalist State in an attempt to adapt social problems to the requirements of capital. |

Artigos inéditos Freedom of Expression in American Law: Foundations, Limits, and the Problem of Uncritical Reception in Brazil Cunha, Marcelo Barros da Abstract in Portuguese: Resumo O artigo examina criticamente a percepção, difundida no discurso jurídico e político brasileiro, de que a liberdade de expressão no direito americano seria quase absoluta. Abstract in English: Abstract This article critically examines the widespread perception in Brazilian legal and political discourse that freedom of expression in American law is virtually absolute. By analyzing the main theories justifying free speech — the marketplace of ideas, democratic self-governance, individual autonomy, negative theory, and consequentialism — and the United States Supreme Court's jurisprudence, with emphasis on unprotected speech categories and constitutional scrutiny standards, the article demonstrates that the American system establishes substantive limits on speech, structurally distinct from those of Brazilian law. The article confronts this framework with the Brazilian constitutional regime, in light of the 1988 Federal Constitution and the Federal Supreme Court's jurisprudence — particularly ADPF 130 and HC 82.424. The article concludes that the image of unrestricted American free speech constitutes a legal myth with practical consequences in Brazilian public debate, and that overcoming it requires rigorous comparative methodology and attention to the structural and institutional conditions that shaped each system. |

Abstract in English: Abstract The use of Generative Artificial Intelligence (GAI) in academic writing is often debated through the lens of technical integrity or productive efficiency. However, for researchers located in the Global South, this technology acts as a geopolitical mediator of knowledge whose effects transcend the technical dimension. This article analyzes whether GAI serves as a bridge for scientific internationalization or as a filter that deepens data colonialism. Drawing on the Epistemologies of the South and a Decolonial Illustrative Output Exercise applied to two case studies — Andean cosmology (Sumak Kawsay) and Amazonian territorial science — we discuss, drawing on a qualitative illustrative exercise, how automated refinement tends to “domesticate” native analytical categories, replacing them with hegemonic terms from the Global North. We conclude that epistemic justice in the algorithmic era requires not only a Decolonial Review framework but also a structured legal response: the consolidation of epistemic sovereignty as a collective fundamental right and the incorporation of epistemic justice criteria into artificial intelligence regulatory frameworks, ensuring that technology amplifies the researcher’s voice without compromising their intellectual sovereignty. |

Abstract in English: Abstract The aim of this paper is to examine the extent to which John Rawls’s theory of justice can be reformulated to address environmental issues at the domestic level. The analysis draws on the contractualist devices of the theory—namely, the original position and the veil of ignorance—with the aim of introducing, at its normative core, certain constraints related to the imperatives of sustainability. Specifically, I propose the formulation of a principle of sustainability: a restriction on the difference principle that anticipates and prevents the degradation of basic environmental conditions, ensuring the continuity of just social cooperation over time, from one generation to the next. I also argue for the inclusion of a category of “environmental goods,” such as clean air and water, which could be incorporated into the list of primary goods as means necessary to pursue any reasonable conception of the good and which, therefore, would not rely on any particular notion of the good life. Such an inclusion appears to be fully compatible with the general structure of Rawls’s theory of justice. |

Abstract in English: Abstract This article aims to investigate the level of compliance in the regulatory strategies for the use and protection of data adopted by Brazil’s 27 states with respect to the objectives of the Brazilian General Data Protection Law (LGPD). Drawing upon frameworks from responsive regulation theory, we conducted a content analysis of state-level regulatory instruments designed to guide data use within public administration. Our findings reveal that these strategies generally lack provisions for social participation and largely reflect formal compliance, with the objective of avoiding the application of sanctions. Without more solid institutional arrangements, the current structures risk leading to inconsistent implementation of citizen data protection objectives and the use of such data for supporting public policies |

Artigos inéditos Between gender violence and mass incarceration of indigenous men: cases of protective measures for Guarani and Kaiowá indigenous women in Mato Grosso do Sul (2018-2025) Galhera, Katiuscia Moreno Faisting, André Luiz Becker, Simone Abstract in Portuguese: Resumo O objetivo deste artigo é tratar da violência contra as mulheres indígenas da etnia Guarani e Kaiowá no Mato Grosso do Sul, entre os anos de 2018 e 2025. Abstract in English: Abstract The aim of this article is to reflect about violence against indigenous women of the Guarani and Kaiowá ethnic groups in Mato Grosso do Sul, Brazil, between 2018 and 2025. All legal cases have in common the request for protective measures under Maria da Penha Law. However, violence against these women, according to their own perspectives, goes far beyond the exemplary provisions of the law. The study hypothesizes that the application of the Maria da Penha Law constitutes a universalizing legal instrument that does not fully address the specificities of these Indigenous peoples. Methodologically, the research includes a literature review, analysis of the entire content of ten cases involving requests for protective measures, and on-site observation of debates on violence against indigenous women by Guarani and Kaiowá women themselves. The findings demonstrate that biopower in Mato Grosso do Sul has a dual function of death: through the insufficient protection afforded to Indigenous women and through the mass incarceration of Indigenous men. |

Artigos inéditos Uneven and combined development and critique of bourgeois legality: Leon Trotsky, Franz l. Abstract in English: Abstract This article articulates the theory of uneven and combined development (UCD), formulated by Leon Trotsky and taken up by world historical sociology, with Franz L. Neumann’s critique of the transformation of legality under monopoly capitalism. It argues that UCD offers a relational grammar for understanding how pressures from the globalized market, interstate competition, and international credit produce, in various contexts, hybrid arrangements between modern and traditional forms of life. Neumann, in turn, describes the Nazi regime as the displacement of legality from the register of universal norms to that of particularistic and selective measures, preserving the appearance of generality while altering its function. Based on this approach, the notion of a hybrid legal arrangement is proposed to explain the coexistence of legality and autarky in various contexts, and a research agenda is outlined to investigate the erosion of the rule of law in cycles of crisis. |

Abstract in English: Abstract This study analyzes the Brazilian tax system from its structural racial dimensions, focusing on legislative omission in the regulation of the Tax on Large Fortunes (IGF) as a technology for reproducing structural racism. It starts from the recognition that this omission does not stem from technical deficiencies, but reflects an implicit political pact that ensures the perpetuation of racialized patrimonial privileges and prevents the fair redistribution of wealth. The theoretical framework articulates critical sociology, political philosophy, and theories of structural racism, with an emphasis on the notions of fiscal coloniality, necropolitics, and symbolic constitutionalization. The methodological approach is qualitative, with a descriptive and explanatory design, combining a literature review and critical analysis of discourses, using secondary statistical data from national and international sources to contextualize racial disparities. The results indicate that the absence of the IGF constitutes a pillar of fiscal policy and that its regulation represents an ethical, constitutional, and civilizational condition for the construction of a democratic and anti-racist fiscal pact. |

Abstract in English: Abstract The article deals with the conviction of the Brazilian State in the Inter-American Court of Human Rights (IACHR) for the forced disappearance of young people in the case that became popularly known as “Mães de Acari” (Mothers of Acari), due to the struggle of the mothers in their search for the whereabouts of their children. The overall objective is to analyze Brazil's conviction in the IACHR in the ‘Mothers of Acari’ case for the forced disappearance of young people as a reflection of the rights to memory and truth in the democratic period. The guiding research question is: how does Brazil's conviction in the IACHR in the ‘Mothers of Acari’ case for the forced disappearance of young people reflect the rights to memory and truth in the democratic period? The deductive approach, the monographic procedure method, and bibliographic and documentary research techniques are used for the methodology of writing the article. It is concluded that Brazil's conviction highlights a partial break in the pattern of state impunity. However, it was found that the continuous non-compliance with reparation measures by the Brazilian State - especially the persistent omission in the autonomous criminalization of the offense in domestic law - perpetuates institutional violence and demonstrates the urgency of implementing public memory and truth policies for democratic consolidation. |

Artigos inéditos Gender climate injustice: The application of disaster law in the may 2024 flooding in Santa Maria-RS Colnaghi, Júlia Nobre Tybusch, Francielle Benini Agne Abstract in Portuguese: Resumo O desenvolvimento tecnológico desenfreado resultou na destruição de ecossistemas, com severos impactos sociais e ambientais. Abstract in English: Abstract Unrestrained technological development has resulted in the destruction of ecosystems, with severe social and environmental impacts. These effects are unevenly distributed across society, particularly affecting women in situations of vulnerability. In this context, disaster law emerges, aimed at prevention, mitigation, and reconstruction in the face of catastrophes. However, research on climate injustice and female vulnerability has mostly focused on theoretical aspects, without effectively considering the population’s voice. This article seeks to fill this gap by investigating the climate gender injustice triggered by the April/May 2024 disaster in Santa Maria–RS, from the perspective of disaster law. A literature review and field research with local women were conducted. The findings reveal that, in disaster scenarios, women are disproportionately affected. As a contribution, the study provides a concrete view of the difficulties faced by them in this context. |

Artigos inéditos Historical Criminology as a Southern Criminology: an example from punitive practices in Curitiba/PR, Brazil (1940-1960) Machado, Matheus Hatschbach Abstract in Portuguese: Resumo O presente trabalho investiga as práticas punitivas em Curitiba (1940-1960) para demonstrar a necessidade de integrar a pesquisa histórica às Criminologias do Sul. Abstract in English: Abstract This study investigates punitive practices in Curitiba (1940–1960) to demonstrate the necessity of integrating historical research into Southern Criminologies. The justification lies in the insufficiency of Global North theories to explain peripheral reality, requiring a diachronic analysis to denaturalize concepts and comprehend the coloniality of punitive power. The article emphasizes that the use of History must entail a critical reflection on the nature of historical time and, especially, on the past as an analytical category—a topic recently addressed within the field of Historical Criminology. Methodologically, the study articulates a theoretical review with an empirical analysis of criminal and census statistics, confronting formal incarceration rates with records of police detentions. The results indicate that, despite modernization and State consolidation following the Vargas Era, incarceration rates in Curitiba declined; instead, a diffuse form of social control prevailed via detentions for contraventions and arrests for investigation (averiguações), characterized by disproportionate repression of the Black population. It is concluded that local punishment prioritized the police management of social hierarchies to the detriment of classical incarceration. |
