RESUMO Este artigo revisita o contexto e as disputas políticas ocorridas durante a Assembleia Constituinte de 1987-1988 com o objetivo de identificar fatores institucionais que ajudem a explicar as características da Carta por ela promulgada e a justificar a preservação do cerne desta, a despeito da intensa série de emendas ao longo dos 30 anos de sua existência.

ABSTRACT This article revisits the context and the political struggles during the Constituent Assembly of 1987-1988, in order to explain the characteristic traits of the Constitution it drafted and to justify why the core of its text remained preserved despite the several amendments approved throughout the thirty years of its existence.

RESUMO A Constituição Federal (CF) de 1988 representou o resultado de uma bem-sucedida transição democrática inclusiva, pela qual mudanças paradigmáticas nas políticas sociais produziram a inclusão dos outsiders, mecanismo este que não apenas reduziu desigualdades como operou como um contrapeso aos efeitos da crise econômica. Por outro lado, a CF 88 também desenhou uma política tributária regressiva. Buscar o equilíbrio fiscal não requer desfazer as políticas inclusivas.

ABSTRACT The 1988 Federal Constitution (FC) concluded a successful inclusive democratic transition, where paradigmatic shifts in social policies produced the inclusion of outsiders, a mechanism that not only reduced inequalities but also operated as a counterweight to the effects of the economic crisis. On the other hand, the FC 88 also designed a regressive tax policy. Striving for fiscal balance does not require breaking down inclusive policies.

RESUMO O objetivo deste artigo é analisar os efeitos econômicos da Constituição Federal do Brasil. A Constituição brasileira é uma das mais longas e detalhadas do mundo. Concluímos que, tanto em razão de provisões específicas como por causa da extensão do texto, a Constituição brasileira tende a aumentar o gasto governamental.

ABSTRACT The goal of this article is to examine the economic effects of some provisions on the Federal Constitution of Brazil. The Constitution of Brazil is one of the longest and most detailed constitutional texts in the world. We find that both because of the specific provisions of the text, but also by the political economy implications of the sheer length, the Brazilian Constitution tends to increase governmental spending.

RESUMO Há 30 anos, na Constituição, os direitos dos índios, que já eram consagrados na República desde a Carta de 1934, foram, pela primeira vez, objeto de um capítulo específico. O estudo dos desmandos praticados contra eles levou a uma fundamentação e a uma explicitação desses direitos. O modo de vida dos povos indígenas no Brasil foi reconhecido, bem como sua capacidade jurídica autônoma acrescida da proteção do MPF. Na Constituinte, acusações orquestradas de conspiração contra os interesses nacionais procuraram sem sucesso total destruir os avanços logrados. Nunca desistiram, e hoje acumulam-se ameaças aos direitos constitucionais dos índios.

ABSTRACT Thirty years ago, 1988 Brazilian Constitution dedicated a specific chapter to the rights of indigenous peoples. Studies about violations of indigenous rights led them to in that chapter the foundation and explanation of these rights. The way of life of the different indigenous peoples in Brazil was recognized, as well as their autonomous legal capacity. During the work of the Constituent Assembly, orchestrated accusations of conspiracy against national interests sought, without total success, to destroy the obtained accomplishments. These attacks never relinquished and there are nowadays numerous threats to the constitutional rights of indigenous peoples.

RESUMO Este artigo trata do modo de escritura do filosofo alemão Walter Benjamin (1892-1940), escritura essa ao mesmo tempo poética e filosófica. Circulando entre os choques da vida moderna e as profundezas do desejo coletivo, ela faz colidir o mais atual com o mais antigo, por meio de um estilo teorizado com ironia pelo próprio autor na margem de suas grandes obras.

ABSTRACT This article deals with Walter Benjamin’s techniques of writing, a writing which is at the same time poetical and philosophical. Moving along the shocks of modern life and the deepness of collective desire, this way of writing makes collide what is more up-to-date with what is more antique by the mean of a style theorized with irony by the author in the margin of his great works.

RESUMO O artigo reconstrói as disputas na Associação Americana de Filosofia (APA) que culminaram, em 1979, na chamada “Rebelião Pluralista”. Um dos personagens centrais desse drama foi o filósofo Richard Rorty (1933-2008), formulador intelectual das queixas de insatisfação disciplinar e institucional que eclodiram na reunião anual da associação naquele ano. O episódio pode ser interpretado como um caso exemplar de processos de mudança intelectual envolvendo crise institucional e a emergência de movimentos científicos/intelectuais.

ABSTRACT The article reconstructs the disputes in the APA that led, by the end of the 1970s, to the so-called Pluralist Rebellion. One of the central characters of this event was philosopher Richard Rorty (1933-2008), who had a crucial role as an intellectual framer of the disciplinary discontent which erupted in the 1979 meeting of the association. The article concludes by showing how the episode might be interpreted as an exemplary case of processes of intellectual change that involve institutional crisis and the emergence of scientific/intellectual movements.

RESUMO No século XX, dois filósofos, M. Heidegger e L. Wittgenstein, revisitaram os princípios de nossa filosofia - aquela dos gregos - e questionaram suas bases. Em outras palavras, examinaram o próprio conceito de fundamento: o “Ser” como totalidade, tomado em múltiplos sentidos mediante os quais os entes ganham sentido. Se o Ser deve ser pensado como o tempo se apropriando do homem, Heidegger precisa definir a própria linguagem como exercício de apropriação de cada ente que é e o próprio Ser. Wittgenstein, em contrapartida, considera a linguagem como jogo que se ocupa de signos e objetos. Consequentemente, questionar o ser é um erro gramatical. Para ambos os filósofos, o conceito de razão carece de sentido, independentemente de como é concebido.

ABSTRACT In the twentieth century, two philosophers, M. Heidegger and L. Wittgenstein, revisited the principles of our philosophy - that of the Greeks - and questioned its basis. In other words, they inquired about the concept of foundation itself: “Being” as wholeness, taken in multiple senses, through which any being that is receives meaning. If Being should be thought as time appropriating the man, Heidegger needs to define language itself as an exercise of approprieting every thing that is and the Being itsef. Wittgenstein, on the other hand, considers language as a game that deals with signs and objects. Therefore, questioning about being is a grammatical mistake. Consequently, for both philosophers, the concept of reason lacks meaning, independently of how we conceive it.

RESUMO Em sua longa carreira de editor, Alfred Knopf buscou incessantemente autores latino-americanos promissores. Entretanto, traduzir e publicar não foram as únicas maneiras pelas quais sua editora influenciou a recepção da literatura latino-americana nos Estados Unidos. Para cada livro latino-americano traduzido, Knopf e seus editores assistentes rejeitaram muitos outros. Este artigo analisa como as obras de autores brasileiros foram avaliadas pela editora Alfred A. Knopf, Inc. e discute o intricado processo de seleção de literatura estrangeira para tradução em inglês.

ABSTRACT As a lifelong editor, Alfred Knopf relentlessly searched Latin America for promising authors. But translating and publishing were not the only ways his firm helped to shape the reception of Latin American literature in the United States. On the flip side, for each Latin American book translated, Knopf and his associate editors rejected many others. This article analyses how the works of Brazilian writers were assessed by the Alfred A. Knopf, Inc. and discusses the intricate operation of selecting foreign fiction for translation into English.
