Childhood Education: advances in legislation and challenges for municipalities

This study analyzes the advances and challenges of Brazilian legislation for early childhood Education. The central problem seeks to understand the impacts of the legal framework on the initial stage of basic Education and the obstacles faced by municipalities in its implementation. Methodologically, a documentary analysis of the 1988 Federal Constitution, the LDB nº 9.394/96, and the National Education Plan (2014-2024) was carried out, and the challenges faced by municipal management were referenced in case study research (Ximenes; Oliveira; Silva; 2019; Silveira et al, 2020; Marques, 2023; Bruno; Silveira, 2023). The theoretical foundation is anchored in discussions on the right to quality Education (Ximenes, 2014). Partial results indicate that, although the normative progress is significant, practical implementation is hampered by budgetary and structural limitations. The consolidation of legislation is limited to the efforts of municipalities, which are responsible for early childhood Education, even though there is a legal mandate from the federal pact, which, however, is not being fulfilled.
