Constituent power and the feminist approach: an analysis of the Constituent Assembly in Brazil in 1987 Brugnerotto, Thais Andrade Houghton, Ruth

Resumo: O poder constituinte é compreendido como o poder de realizar mudanças constitucionais. No constitucionalismo moderno, "o povo" é o legítimo detentor desse poder e pode exercê-lo para redigir uma nova constituição. O estudo das práticas participativas no exercício do poder constituinte é especialmente relevante para os estudos feministas sobre o constitucionalismo, cujo foco está em compreender como as mulheres foram incluídas ou excluídas dos processos de elaboração constitucional. No entanto, focar apenas na participação tem se mostrado insuficiente para garantir a proteção plena das mulheres e de grupos marginalizados. É essencial, portanto, considerar a complexa relação entre os sujeitos constituintes, as práticas e os procedimentos envolvidos nos exercícios do poder constituinte e seu potencial impacto sobre a constituição propriamente dita. Inserido nos estudos sobre o constitucionalismo feminista, este trabalho investiga o papel da representação nos processos de elaboração constitucional no Brasil.

Abstract in English:

Abstract: Constituent power is understood as the power to bring about constitutional change. In modern constitutionalism, ‘the people’ are the legitimate holders of this power and they can exercise their constituent power to write a new constitution. Studying participatory practices in constituent power is especially relevant to feminist constitutional studies, where the focus is on understanding how women have been included or excluded from constitution-drafting. Focusing on participation alone though has been shown to be insufficient to ensure the full protection of women and marginalized groups. Rather, it is essential to consider the complex relationship between the constituent subjects, practices and procedures within exercises of constituent power and their potential influence on the constitution itself. Situated within the studies on feminist constitutionalism, this study explores the role of representation within the constitution-drafting processes in Brazil.

The inconsistencies of the doctrine of unconstitutional constitutional amendments Pardo-Álvarez, Diego

Resumo: Este artigo examina criticamente a influente doutrina das emendas constitucionais inconstitucionais (ECI) de Yaniv Roznai, que visa a reconciliar o controle judicial das emendas constitucionais com a democracia, fundamentando tanto os limites da reforma quanto o controle judicial no poder constituinte do povo. Através de uma análise da experiência chilena com uma constituição imposta e sua subsequente transformação democrática por meio de emendas, o artigo demonstra dois problemas fundamentais na teoria de Roznai. Primeiro, a doutrina das ECI mostra-se inadequada para casos em que o poder de emenda serve para superar um passado autoritário, pois não consegue conceituar adequadamente a função possibilitadora da democracia do poder de reforma. Segundo, o artigo revela como a construção teórica de Roznai mina seus próprios fundamentos: sua compreensão normativo-ideal do poder constituinte contradiz o conceito político que afirma adotar, enquanto sua teoria da delegação negligencia a dimensão habilitadora do poder de emenda e sua defesa do controle judicial dos limites implícitos contradiz a própria teoria do poder constituinte que pretende proteger. O artigo conclui que a tentativa de Roznai de imunizar o controle judicial contra a dificuldade contramajoritária acaba fracassando devido a essas contradições internas.

Abstract: This article critically examines Yaniv Roznai’s influential doctrine of unconstitutional constitutional amendments (UCA), which aims to reconcile judicial review of constitutional amendments with democracy by grounding both amendment limits and judicial review in the people’s constituent power. Through an analysis of Chile’s experience with an imposed constitution and its subsequent democratic transformation through amendments, the article demonstrates two fundamental problems with Roznai’s theory. First, the UCA doctrine proves inadequate for cases where amendment power serves to overcome an authoritarian past, as it cannot properly conceptualize amendment power’s democratic enabling function. Second, the article reveals how Roznai’s theoretical construction undermines its own foundations: his normative-ideal understanding of constituent power contradicts the political concept he claims to adopt, while his theory of delegation neglects amendment power’s enabling dimension and his defense of judicial review of implicit limits contradicts the very theory of constituent power it purports to protect. The article concludes that Roznai’s attempt to immunize judicial review from the counter-majoritarian difficulty ultimately fails due to these internal contradictions.

A Self-Eating Snake: Half-truths in the Chilean Constituent Process and Lessons for The Content Moderation Debate Acevedo Mundaca, José

Resumo: Em 18 de dezembro de 2023, uma estátua de um ouroboro - uma serpente que morde a própria cauda - foi instalada na capital do Chile, simbolizando as tentativas fracassadas do país de substituir sua Constituição. Apesar do apoio inicial de 78%, em 2019, à substituição da Constituição de Pinochet, duas propostas consecutivas foram rejeitadas, em 2022 e em 2023. As redes sociais desempenharam um papel ambíguo nesse processo, ao mesmo tempo em que possibilitaram a participação cidadã na política constitucional e facilitaram a disseminação de interpretações constitucionais tendenciosas. A partir da experiência chilena e das interpretações constitucionais mais relevantes e contestadas ao longo do processo, este artigo analisa como a abertura democrática e pluralista dos textos constitucionais a diferentes visões políticas mostrou-se vulnerável a acusações generalizadas de desinformação. A interpretação constitucional é uma atividade política; por isso, interpretações “meio verdadeiras” - situadas dentro dos limites constitucionais, mas utilizadas para promover um determinado voto no plebiscito constituinte - resistem às abordagens tradicionais de moderação de conteúdo. O artigo estrutura uma proposta regulatória que enfrenta esses desafios sem determinar de forma arbitrária a legitimidade interpretativa nem se concentrar no conteúdo hospedado pelas plataformas de redes sociais. Esses achados e recomendações de política pública oferecem lições fundamentais para futuros processos constituintes em todo o mundo e contribuem para os debates mais amplos sobre moderação de conteúdo na política constitucional e no contexto da América Latina.

Abstract: On December 18th, 2023, a statue of an Ouroboro -a snake eating its own tail- was placed in Chile's capital, symbolizing the country’s failed attempts at constitutional replacement. Despite 78% of initial support in 2019 to replace Pinochet’s constitution, two consecutive proposals were rejected in 2022 and in 2023. Social media played a dual role in this process, enabling citizen participation in constitutional politics and facilitating the spread of tendentious constitutional interpretations. Drawing on Chile’s experience and the most salient contested constitutional interpretations in the process, this article analyzes how the democratic and pluralistic openness of constitutional texts to diverse political visions was vulnerable to widespread accusations of misinformation. Constitutional interpretation is a political endeavor; thus, "half-truthful” interpretations -within constitutional bounds but used to promote a particular vote in the constituent plebiscite- resist standard content moderation approaches. The article structures a regulatory proposal that addresses these challenges without arbitrarily determining interpretative legitimacy or focusing on the content that social media platforms host. These findings and policy recommendations offer crucial lessons for future constituent processes worldwide and contribute to broader debates about content moderation in constitutional politics and the Latin American region.

Antiformalist legal theory as an interpretative framework for Latin American constitutionalism Perilla Granados, Juan Sebastián Alejandro

Resumen: El contexto jurídico latinoamericano ha ocupado el rol de sitio de recepción de las de los elementos hermenéuticos de las diferentes escuelas del derecho consolidadas en el norte global. Así, si han adoptado elementos del naturalismo, positivismo, funcionalismo, realismo, utilitarismo, entre otras propuestas teóricas que han aportado la consolidación de la cultura jurídica latinoamericana. En el caso específico del derecho constitucional, como consecuencia de este trasplante teórico, los ordenamientos jurídicos del sur global han conjugado dos teorías de interpretación que actualmente están en pugna: el formalismo y el antiformalismo. El presente artículo pretende abordar esta pugna para determinar el alcance iusteórico que está llamado a implementarse como marco de interpretación para el derecho constitucional actualmente existente en los sistemas jurídicos latinoamericanos. Para tal fin sea con un enfoque de investigación hermenéutico crítico basado en métodos de investigación cualitativa.

Abstract: The Latin American legal context has taken on the role of a site for the reception of the hermeneutic elements from the various schools of law consolidated in the global North. Thus, it has adopted elements from naturalism, positivism, functionalism, realism, utilitarianism, among other theoretical proposals that have contributed to the consolidation of Latin American legal culture. In the specific case of constitutional law, as a result of this theoretical transplant, the legal systems of the global South have combined two interpretive theories that are currently in conflict: formalism and antiformalism. This article aims to address this conflict in order to determine the theoretical scope that is to be implemented as the interpretive framework for the currently existing constitutional law in Latin American legal systems. To this end, a critical hermeneutic research approach is employed, based on qualitative research methods.

The hybrid nature of horizontality in EU Data Protection Law: the Charter, the Regulation and the Court of Justice of the EU Moniz, Graça Canto

Resumo: Este artigo analisa o efeito horizontal do direito fundamental à proteção de dados consagrado no artigo 8.º da Carta dos Direitos Fundamentais da União Europeia. Para além dos debates doutrinais, o texto adota uma perspetiva funcional e institucional, ancorada na arquitetura do direito da proteção de dados da União Europeia. Propõe um quadro analítico tripartido - efeitos direto, indireto e mediado pelo Estado - e sustenta que o artigo 8.º sintetiza estes modelos num sistema de horizontalidade estruturalmente híbrido. Este modelo híbrido é operacionalizado através do Regulamento Geral sobre a Proteção de Dados, que inscreve os direitos fundamentais nas relações privadas por via do desenho legislativo, da implementação descentralizada e da supervisão regulatória. O Tribunal de Justiça complementa este modelo por meio de uma interpretação teleológica, afirmando a horizontalidade dos direitos fundamentais mesmo na ausência de uma doutrina geral sobre o efeito horizontal. O artigo conclui que a aplicação horizontal do artigo 8.º não constitui uma exceção ao paradigma vertical, mas uma necessidade estrutural numa ordem digital cada vez mais moldada pelo poder regulatório de atores privados.

Abstract in English:

Abstract: This article analyses the horizontal effect of the fundamental right to data protection enshrined in Article 8 of the EU Charter of Fundamental Rights. Moving beyond abstract doctrinal debates, it adopts a functional and institutional perspective grounded in the architecture of EU data protection law. It proposes a tripartite analytical framework - direct, indirect, and state-mediated effect - and argues that Article 8 synthesises these models within a structurally hybrid system of enforceability. This hybrid model is operationalised through the General Data Protection Regulation, which embeds fundamental rights in private relationships via legislative design, decentralised implementation, and regulatory oversight. The Court of Justice complements this model through purposive interpretation, affirming rights enforceability even in the absence of a general doctrine of horizontal effect. The article concludes that the horizontal application of Article 8 is not an exception to verticality but a structural necessity in a digital order increasingly shaped by private regulatory power.

Resumen: En las democracias contemporáneas el Poder Legislativo tiene un papel importante como instancia donde se crean las leyes, por ello, la producción legislativa requiere de conocimientos profundos sobre la realidad y las necesidades de un país, además, del manejo de los procedimientos teórico-prácticos para su elaboración. Para que estas sapiencias se hagan realidad, es necesario que el legislador cuente con formación profesional y académica suficiente en las ramas de su especialidad. En la presente investigación se analizó el nivel académico de los congresistas peruanos de los últimos dos periodos legislativos (2020-2021 y 2021-2026), demostrando que, una gran cantidad de los mismos carecen de estudios superiores lo que, de cierta manera, permite entender la ausencia de precisión, técnica y sensatez en la elaboración de leyes.

Abstract: In contemporary democracies, the legislative branch plays an important role as the body where laws are created. Therefore, legislative production requires in-depth knowledge of a country's reality and needs, as well as mastery of the theoretical and practical procedures for its development. For this knowledge to become a reality, legislators must have sufficient professional and academic training in their fields of expertise. This research analyzed the academic level of Peruvian Congressmen from the last two legislative periods (2020-2021 and 2021-2026), demonstrating that a large number of them lack higher education, which, in a certain way, allows us to understand the lack of precision, technique, and common sense in the drafting of laws.

Climate change, vulnerability and decent housing: the case of the 2024 flood in Canoas/RS Rehbein, Katiele Daiana da Silva Alves, Felipe Dalenogare

Resumo: O estudo analisa a população de Canoas/RS afetada pela enchente de 2024, com foco na garantia do direito à moradia, tendo como questão central o seguinte: quais fatores determinam a vulnerabilidade da população nos bairros acometidos pela enchente de 2024 em Canoas/RS e quais políticas habitacionais foram estabelecidas para atender suas necessidades e garantir o direito à moradia? Assim, a pesquisa foi dividida em três etapas: a primeira explora as mudanças climáticas nos aspectos históricos e normativos; a segunda analisa o evento de 2024 e a população impactada em Canoas/RS; e, finalmente, mapeia-se as políticas habitacionais utilizadas. A teoria de base foi a sistêmico-complexa, com abordagem hipotético-dedutiva e quantitativa, conduzida pelo procedimento descritivo e exploratório, e técnicas bibliográfica e análise de dados. Conclui-se que a vulnerabilidade decorre de fatores como renda, gênero e raça, e as políticas habitacionais emergenciais não abrangem completamente esses grupos.

Abstract: The study analyzes the population of Canoas/RS affected by the 2024 flood, focusing on the guarantee of the right to housing, with the following central question: what factors determine the vulnerability of the population in the neighborhoods affected by the 2024 flood in Canoas/RS and what housing policies have been established to meet their needs and guarantee the right to housing? Thus, the research was divided into three stages: the first explores climate change in its historical and normative aspects; the second analyzes the 2024 event and the population impacted in Canoas/RS; and finally, the housing policies used are mapped. The basic theory was systemic-complex, with a hypothetical-deductive and quantitative approach, conducted using a descriptive and exploratory procedure, bibliographic techniques and data analysis. It was concluded that vulnerability is due to factors such as income, gender and race, and that emergency housing policies do not fully cover these groups.
