The Public Defender´s Office and the defense of the right to adequate housing: an analysis of the institutional approach in Brazil Noronha, Silvia Gomes Fischer, Luly Rodrigues da Cunha

Abstract in Portuguese:

Resumo O artigo analisa como a Defensoria Pública vem se organizando e priorizando a defesa do direito à moradia como política pública institucional, assim como a contribuição da instituição na temática. Como abordagem metodológica, foi realizada pesquisa exploratória com análise documental para exame quali-quantitativo de dados. Ao final, foi realizada revisão bibliográfica sistemática para subsidiar a análise. Concluiu-se que as Defensorias Públicas, de maneira geral, vêm atuando de forma estratégica na defesa do direito à moradia por meio da instalação gradativa de núcleos especializados ao longo dos anos e que, à exceção de poucos estados da federação, ainda não foram construídos parâmetros para atuação, que vem se consolidando e necessita de fortalecimento em relação ao trabalho integrado com equipe interdisciplinar visando à defesa da população vulnerabilizada em conflitos fundiários urbanos e à garantia do direito à moradia.

Abstract in English:

Abstract The article analyzes how the Public Defender´s Office have been organizing themselves and prioritazing the defense of the right to housing as an institutional public policy, as well as the institution´s contribution to the topic. As a methodological approach, an exploratory research was carried out with documentary analysis to examine quanti-quali data. At the end, a systematic bibliographic review was performed. It was concluded that the Public Defender´s Offices in general have been acting strategically in defending the right to housing, through the gradual installation of specialized centers over the years and that, with the exception of a few States of the federation, it has not been built parameters of action, which has been consolidated and needs strenghthening in regard to integrated work with an interdisciplinar team aimed at defending the vulnerable population in urban land conflicts and guarantee the right to housing.

From the ground to the institution: the discussion of gender and housing in the São Paulo Court of Justice Valadares, Raquel Gomes Moreira, Tomás Antonio

Resumo A pesquisa tem como objetivo identificar se a assimetria de gênero é um elemento considerado nas ações processuais sobre acesso à moradia, articulado por movimentos sociais urbanos, aplicando como método de investigação a análise de conteúdo das decisões e recomendações do Tribunal de Justiça do Estado de São Paulo, comarca da capital, entre os anos 2010 a 2020. Nem todas as ações judiciais têm discussões, ou vislumbra-se encontrar discussões, sobre os papéis de gênero, entretanto, quando existe um sujeito coletivo com uma quantidade expressiva de mulheres atuantes, sendo esta característica recorrente aos movimentos de moradia urbana no âmbito nacional, o sistema de justiça incide no dever de observá-las não apenas como números, mas como meio de enfrentamento à generificação da pobreza e da inacessibilidade aos espaços de formação do discurso político e normativo. A moradia como espaço de inserção social e da realização pessoal, soma-se aos aspectos de análise dos movimentos sociais constituindo um desafio aplicá-los aos estudos jurídicos e de gênero.

Abstract in English:

Abstract The aim of this research is to identify whether gender asymmetry is an element considered in lawsuits over access to housing, articulated by urban social movements, applying content analysis of decisions and recommendations from the São Paulo State Court of Justice, in the capital, between 2010 and 2020. Not all lawsuits have discussions, or are likely to have discussions, about gender roles. However, when there is a collective subject with a significant number of active women, and this is a recurring characteristic of urban housing movements nationwide, the justice system has a duty to observe them not just as numbers, but as a means of confronting the generification of poverty and inaccessibility to the spaces where political and normative discourse is formed. These are actions that resist, challenge and affirm certain relationships and ways of living together. Housing as a space for social inclusion and personal fulfilment is added to the aspects of social movement analysis, making it a challenge to apply them to legal and gender studies.

Common (Good)?: On Horizons for the Realization of the Right to the City in Latin America Canestraro, María Laura

Resumen Recientemente se ha planteado que la asunción de la ciudad como bien común otorgaría operatividad al derecho a la ciudad (Fernandes, 2021), teniendo en cuenta la persistente concepción restringida y limitada de aquel (Canestraro y Jakubowicz, 2021), originada en su falta de concreción y abstracción (Guillén Lanzarote, 2011). En este contexto, y poniendo el foco en la región latinoamericana, este artículo se pregunta por las condiciones que viabilizarían tal efectivización, indagando en torno a las temporalidades y demandas que se articulan, los entramados actorales que se configuran y cuáles han sido las tensiones alrededor de la mercantilización y desmercantilización del proceso de urbanización (Pírez, 2016a). Para ello, se construye un corpus analítico recuperando el debate en torno al derecho a la ciudad y los (bienes) comunes buscando posibles entrecruzamientos entre ambos, en vistas a dar cuenta de los interrogantes planteados. Se concluye en que el Estado asume una centralidad en el debate, ya sea como mediador entre el ciudadano y el mercado, o bien como parte de una nueva racionalidad política. Es alrededor de esa distinción que operan las principales divergencias entre ambas perspectivas.

Abstract It has recently been suggested that the assumption of the city as a common good would grant operational validity to the right to the city (Fernandes, 2021), taking into account the persistent restricted and limited conception of the former (Canestraro y Jakubowicz, 2021) originating from its lack of concreteness and abstraction (Guillén Lanzarote, 2011). In this context, and focusing on the Latin American region, this article examines the conditions that would make such an implementation viable, investigating the temporalities and demands that are articulated, the actor networks that are configured, and the tensions surrounding the commodification and decommodification of the urbanization process (Pírez, 2016a). To this end, an analytical corpus is constructed by recovering the debate surrounding the right to the city and the commons, seeking possible intersections between the two, with a view to addressing the questions raised. The conclusion is that the State assumes a central role in the debate, either as a mediator between citizens and the market or as part of a new political rationality. It is around this distinction that the main divergences between the two perspectives operate.

Resumo Esta pesquisa foi realizada pelo Dom - Grupo de Pesquisa em Antropologia do Direito da Universidade Federal de Minas Gerais, como a segunda e última fase de pesquisa anterior que buscou compreender o estado da arte da Antropologia do Direito no Brasil (Nicácio et al., 2024). Em complementação à análise anterior, focada em publicações periódicas, a investigação voltou-se, nesta fase, para a análise de teses e dissertações constantes nos repositórios da Coordenação de Aperfeiçoamento de Pessoal de Nível Super (CAPES) e que utilizaram as palavras-chave “antropologia do direito” ou “antropologia jurídica” no momento de sua indexação. A escolha foi por repetir, aprofundando-a e aperfeiçoando-a, a metodologia utilizada na primeira fase, baseada na seleção, detalhamento e análise do universo encontrado (5 teses e 31 dissertações). A partir dessas publicações, foram analisados a) universo temático dos trabalhos; b) origem e filiação das pesquisas; c) formação de autores/as; d) estratégias e procedimentos metodológicos utilizados; e) ano de publicação. Como principal resultado, a pesquisa confirmou o gradual e persistente desenvolvimento da Antropologia do Direito como disciplina, tanto nas frentes temática, metodológica e epistemológica, se consolidando no Brasil após seu surgimento nos cursos de Antropologia e sua estabilização nas formações jurídicas.

Abstract This research was carried out by Dom - Research Group on Legal Anthropology at the Federal University of Minas Gerais, as the second and final phase of a previous study that sought to understand the state of the art of the Anthropology of Law in Brazil (Nicácio et al., 2024). In addition to the previous analysis, which focused on periodicals, the investigation turned, in this phase, to the analysis of theses and dissertations contained in the repositories of the Coordination for the Improvement of Higher Education Personnel (CAPES) and which used the keywords “anthropology of law” or “legal anthropology” at the time of their indexing. The choice was to repeat, deepen and refine the methodology used in the first phase, based on the selection, detailing and analysis of the universe found (5 theses and 31 dissertations). Based on these publications, we analyzed a) the thematic universe of the works; b) the origin and affiliation of the research; c) the training of the authors; d) the methodological strategies and procedures used; e) the year of publication. As a main result, the research confirmed the gradual and persistent development of the Anthropology of Law as a discipline, both on the thematic, methodological and epistemological fronts, consolidating itself in Brazil after its emergence in Anthropology courses and its stabilization in legal training.

Judicial indiscretion and constitutional erosion in Brazil Patrus, Rafael Dilly

Resumo Este artigo examina o impacto da exposição midiática e política do Poder Judiciário na democracia. Utilizando uma abordagem jurídico-dogmática, revisa a literatura sobre decadência democrática, erosão constitucional e a relação entre Judiciário e mídia, com foco no Supremo Tribunal Federal. Discute o papel do Judiciário na deterioração dos padrões constitucionais e sua crescente participação em debates públicos. A partir de episódios envolvendo ministros do STF, analisa como essa exposição compromete a legitimidade democrática da jurisdição. Conclui que, apesar da resistência judicial à erosão constitucional no Brasil, a atuação do STF tem intensificado a vulnerabilidade do sistema de justiça ao cenário político-midiático.

Abstract This article examines the democratic impact of the judiciary’s media and political exposure. Using a legal-dogmatic approach, it reviews the literature on democratic decline, constitutional erosion, and the relationship between the judiciary and the media, with a focus on the Brazilian Supreme Court. It discusses the judiciary’s role in the deterioration of constitutional standards and its increasing participation in public debates. Based on episodes involving some Brazilian Supreme Court justices, it analyzes how this exposure undermines the democratic legitimacy of jurisdiction. The study concludes that, despite judicial resistance against constitutional erosion in Brazil, the Brazilian Supreme Court’s actions have heightened the judicial system’s vulnerability to the political-media landscape.

Traditional Knowledge and Indigenous Territory in the Inter-American Human Rights System: A Protection Approach from Collective Property Vargas-Chaves, Iván

Resumen Sistema Interamericano de Derechos Humanos, a través de la Comisión Interamericana y la Corte, se ha convertido en un escenario clave para la protección de los derechos de los pueblos indígenas, especialmente en lo que respecta a las medidas de reparación colectiva. El presente artículo parte del reconocimiento de los derechos que han afectado su territorio, cultura y formas de vida, haciendo un énfasis en la relación intrínseca entre territorio y conocimiento tradicional como propiedad colectiva. Mediante una metodología de análisis documental, se examinan artículos científicos, jurisprudencia de la Corte IDH y otros documentos jurídicos relevantes. Como resultados, el artículo destaca los avances significativos del Sistema Interamericano en el reconocimiento y protección de los derechos indígenas, desafiando perspectivas occidentales tradicionales y adoptando un enfoque más sensible a la diversidad étnica, cultural y territorial. Se concluye que el Sistema Interamericano ha desarrollado avances importantes que permiten superar las limitaciones de una visión individualista y occidental, adoptando un enfoque más inclusivo y respetuoso de la cosmovisión de estas comunidades.

Abstract The Inter-American System of Human Rights, through the Inter-American Commission and the Court, has become a key arena for the protection of the rights of indigenous peoples, especially regarding collective reparation measures. This article is based on the recognition of the rights that have affected their territory, culture and ways of life, with an emphasis on the intrinsic relationship between territory and traditional knowledge as collective property. Through a documentary analysis methodology, scientific articles, the jurisprudence of the Inter-American Court of Human Rights and other relevant legal documents are examined. As a result, the article highlights the significant advances of the Inter-American System in the recognition and protection of indigenous rights, challenging traditional Western perspectives and adopting a more sensitive approach to ethnic, cultural and territorial diversity. It is concluded that the Inter-American System has developed important advances that overcome the limitations of an individualistic and Western vision, adopting a more inclusive and respectful approach to the worldview of these communities.

The privatization of water and the struggle for the commons: translocal resistance and the right to water from the experience of Pittsburgh, Pennsylvania, United States Schroering, Caitlin Osório, Luiz Felipe

Resumo A mercantilização dos recursos naturais não é uma novidade no capitalismo, mas chama a atenção em relação à intensidade e à dinâmica em que ocorre atualmente. O fenômeno é amplo e complexo e não envolve apenas a disputa entre centro e periferia do sistema de Estados, mas, de âmago capitalista e internacionalista, também atinge as populações das grandes potências. O que, todavia, não ocorre sem resistência, mas fomenta movimentos que extrapolam as fronteiras locais, regionais e nacionais. O que demonstra que os capitais, ao buscar sua incessante expansão buscam extrapolar as fronteiras e limites possíveis. Emblemático é o caso da privatização da água potável em Pittsburgh, nos Estados Unidos, que durante 2017 a 2021, fez eclodir importantes manifestações e organizações de movimentos sociais voltadas ao direito à água, em sua defesa enquanto um bem público comum. Com base na teoria da forma mercantil de Pachukanis, a experiência da cidade estadunidense será debatida em suas particularidades, de maneira a relacioná-las com as lutas pelo mundo na crítica ao capitalismo reivindicando um ativismo translocal e o direito aos bens comuns essenciais, como a água. Assim, busca-se apontar com se desdobra o conflito entre a expansão dos capitais e as lutas sociais contrárias.

Abstract in English:

Abstract The commodification of natural resources is not new to capitalism, but it is striking in terms of the intensity and dynamics with which it is currently occurring. The phenomenon is broad and complex and does not only involve the dispute between the center and the periphery of the State system, but, from a capitalist and internationalist core, it also affects the populations of the great powers. However, this does not occur without resistance, and instead fosters movements that go beyond local, regional, and national borders. This shows that capital, in its incessant expansion, seeks to go beyond possible borders and limits. An emblematic case is the privatization of drinking water in Pittsburgh, in the United States, which between 2017 and 2021, gave rise to important mobilizations and social movement organization focused on the right to water, in defense of it as a common public good. Based on Pachukanis' theory of the commodity form, the experience of the United States city will be discussed in its particularities, in order to relate them to the struggles around the world in the critique of capitalism, demanding translocal activism and the right to essential common goods, such as water. Thus, the aim is to point out how the conflict between the expansion of capital and the opposing social struggles unfolds.

The legal pluralism in the Brazilian experience : a critique of Raymundo Faoro’s monist historiography Mansur, João Paulo

Abstract in Portuguese:

Resumo Este artigo investiga a razoabilidade de interpretações historiográficas que reduzem a experiência jurídica brasileira, desde o período colonial, à vontade legiferante do Estado soberano. Para examinar essa vertente, que teve na obra Os donos do poder, de Raymundo Faoro, a sua melhor e mais bem definida expressão, faz-se uma análise de longa duração da história colonial e imperial brasileira em busca de instituições e centros de poder, públicos ou privados, que escapam à chave de leitura monista. Conclui-se que a experiência jurídica brasileira foi complexa, pluralista e repleta de direitos próprios, o que exige da historiografia jurídica uma adequação de sua agenda de pesquisa e de suas metodologias.

Abstract in English:

Abstract This article investigates the reasonableness of historiographical interpretations that reduce the Brazilian legal experience, from the colonial period onward, to the law-making will of the sovereign State. To examine this perspective, which found its most well-defined expression in Raymundo Faoro's work Os donos do poder (“The Owners of Power”), this article conducts a long-term analysis of Brazilian colonial and imperial history in search of institutions and centers of power, whether public or private, that escape the monist framework. It is concluded that the Brazilian legal experience was highly complex, pluralistic, and replete with local laws, which requires legal historiography to adapt its research agenda and methodologies.

Abstract in Portuguese:

Resumo Este artigo apresenta resultados de três projetos que investigaram o comportamento dos atores públicos diante das novas crises, com foco na pandemia de COVID-19. O estudo analisa as reações normativas, administrativas e jurisdicionais do Sistema Interamericano de Direitos Humanos (SIDH), especialmente as ações da Corte Interamericana de Direitos Humanos (CrIDH) e da Comissão Interamericana de Direitos Humanos (CIDH). A pesquisa adotou como critério a expressão “COVID-19” e considerou o período de 2020 a 2023. O objetivo foi mapear os atos do SIDH relacionados ao tema, identificando padrões de violações de direitos humanos durante a pandemia. Os resultados são ainda parciais e a abordagem é descritiva e quantitativa. A metodologia utilizada é a fenomenologia hermenêutica. Seu uso prepara o caminho para a análise futura do uso de mecanismos de justiça de transição para enfrentar crises antigas e novas.

Abstract in English:

Abstract This article presents results from three projects that investigated the behavior of public actors in response to new crises, focusing on the COVID-19 pandemic. The study analyzes the normative, administrative, and judicial reactions of the Inter-American Human Rights System (IAHRS), especially the actions of the Inter-American Court of Human Rights (IACHR) and the Inter-American Commission on Human Rights (IACHR). The research adopted the criterion of the term “COVID-19” and considered the period from 2020 to 2023. The objective was to map the acts of the IAHRS related to the issue, identifying patterns of human rights violations during the pandemic. The results are still partial, and the approach is descriptive and quantitative. The methodology used is hermeneutic phenomenology. Its use paves the way for future analysis of the use of transitional justice mechanisms to address both old and new crises.

Between a report and a law: a case study on oppositional defiant disorder (ODD) Gomes, Isabel Cristina Soares Tebaldi Silva, Dagmar de Mello e Pires, Lenin dos Santos

Abstract in Portuguese:

Resumo O presente artigo discute as contradições entre os dispositivos legais que asseguram o direito à Educação Especial na perspectiva inclusiva e as práticas escolares que ainda reproduzem exclusões. A abordagem é construída a partir da análise de um estudo de caso envolvendo um estudante diagnosticado com Transtorno Opositivo Desafiador (TOD). Observa-se que tanto instituições públicas quanto privadas se mostraram despreparadas ou resistentes em acolher o estudante, baseando-se em critérios normativos próprios e excludentes. Ainda que haja respaldo legal, a ausência de regulamentações práticas e de formação adequada aos profissionais da educação compromete a efetividade das políticas inclusivas. O estudo pode concluir que apesar dos avanços na legislação para pessoas com necessidades específicas, as barreiras atitudinais, pedagógicas e estruturais persistem, apontando para a urgência de uma pedagogia ética, afetiva e verdadeiramente inclusiva, que reconheça e legitime as diferenças no cotidiano escolar.

Abstract in English:

Abstract This article discusses the contradictions between the legal frameworks that guarantee the right to Special Education from an inclusive perspective and the school practices that still reproduce exclusion. Based on the analysis of a case study involving a student diagnosed with Oppositional Defiant Disorder (ODD), we discuss how both public and private institutions studied were shown to be unprepared or unwilling to accommodate the student, relying on normative and exclusionary criteria. Although there is legal support, the lack of practical regulations and adequate professional training undermines the effectiveness of inclusive policies. The study concludes that, despite legal advances, attitudinal, pedagogical, and structural barriers persist, highlighting the urgency for an ethical, affective, and truly inclusive pedagogy that recognizes and legitimizes differences in the school environment.

Gender-sensitive practices in the criminal justice system: reflections based on the Re.nata Project and the experiences of femicide survivors Alvarez, Giulia Martins Ifanger, Fernanda Carolina de Araújo

Resumo O feminicídio tentado causa traumas profundos e duradouros nas vidas das sobreviventes, que enfrentam diversos desafios ao acessarem o sistema de justiça e buscarem apoio. O Projeto Re.nata, uma iniciativa de acolhimento de vítimas diretas e indiretas de feminicídio, com sua atuação multidisciplinar e centrada nas necessidades das vítimas, destaca-se como uma alternativa em meio às práticas revitimizadoras frequentemente observadas no sistema de justiça. No entanto, há uma lacuna no entendimento de como exatamente essas boas práticas contribuem para a recuperação das sobreviventes, quais são as limitações enfrentadas e como modelos como esse podem ser replicados, aprimorados ou integrados a uma política pública-judiciária. Diante disso, este estudo parte da necessidade de aprofundar a análise do Projeto Re.nata, como expressão de um potencial modelo de atendimento institucionalizado às sobreviventes. Para explorar a lacuna, este artigo analisa como o Projeto Re.nata impacta a experiência das mulheres ao acessarem o sistema de justiça. Com base na pesquisa em criminologia feminista, trata-se de investigação qualitativa com participantes atendidas pelo projeto, utilizando entrevistas semiestruturadas como técnica de coleta e análise de conteúdo como técnica de análise dos dados. Os resultados indicam que o Projeto Re.nata contribui para a mitigação das limitações estruturais e sociais enfrentadas pelas vítimas, ao proporcionar escuta qualificada, encaminhamentos e apoio contínuo. A atuação multidisciplinar e com perspectiva de gênero demonstrou impacto positivo na trajetória das participantes, promovendo acolhimento jurídico, psicológico e assistencial, fortalecimento da autonomia e sensação de segurança. No entanto, a pesquisa também identificou desafios, como a ausência de institucionalização, a dependência da voluntariedade da promotora responsável, e as dificuldades de acesso a serviços especializados na rede pública. Conclui-se que iniciativas como o Re.nata têm potencial para se consolidar como políticas públicas-judiciárias efetivas, desde que contem com medidas institucionais que garantam sua continuidade, articulação intersetorial e compromisso com a transversalidade de gênero.

Abstract in English:

Abstract Attempted femicide causes deep and lasting trauma in the lives of survivors, who face numerous challenges when seeking support and accessing the justice system. The Re.nata Project, an initiative aimed at supporting direct and indirect victims of femicide, stands out as an alternative to the revictimizing practices frequently observed within the justice system, due to its multidisciplinary approach centered on the specific needs of victims. However, there remains a gap in understanding how such good practices effectively contribute to the recovery of survivors, what limitations are encountered, and how initiatives like this can be replicated, improved, or integrated into structured public-judicial policies. This study addresses the need to deepen the analysis of the Re.nata Project as a potential model for institutionalized support to survivors. To explore this gap, the article analyzes how the Re.nata Project impacts the experiences of women when accessing the justice system. Grounded in feminist criminology, the study adopts a qualitative approach based on semi-structured interviews with women assisted by the project, employing content analysis as the data analysis technique. The results indicate that the Re.nata Project contributes to mitigating the structural and social limitations faced by victims by providing qualified listening, referrals, and continuous support. Its multidisciplinary and gender-sensitive approach had a positive impact on the participants' trajectories, promoting legal, psychological, and social assistance, fostering autonomy, and enhancing their sense of security. Nonetheless, the research also identified challenges, such as the lack of institutionalization, dependence on the voluntary engagement of the public prosecutor leading the initiative, and difficulties in accessing specialized services within the public network. The study concludes that initiatives like Re.nata have the potential to be consolidated as effective public-judicial policies, provided they are supported by institutional measures that ensure their continuity, intersectoral coordination, and commitment to gender mainstreaming.

Legitimate resistance and contested meanings of democracy: state repression and the 2013 protests Rolim, Sofia Bordin

Resumo Esta pesquisa examina os enquadramentos interpretativos produzidos pela repressão estatal aos protestos de 2013 no Brasil, buscando identificar as concepções normativas de direito à resistência e os limites da resistência considerada legítima que tais enquadramentos expressam. Para isso, examinamos as divergências teóricas sobre os limites da resistência legítima, com base nas distinções entre as perspectivas liberal e de esquerda formuladas por Brown e Halley em sua crítica à mobilização jurídica. Em seguida, examinamos os quadros repressivos formulados em dois momentos centrais da repressão institucional às manifestações: o pronunciamento de Dilma Rousseff em rede nacional e o processo criminal conhecido como o caso dos “23 presos da Copa”. Abstract This research examines the interpretive framings produced by the state repression of the 2013 protests in Brazil, aiming to identify the normative conceptions of the right to resistance and the boundaries of legitimate resistance expressed in these framings. To this end, we examine the theoretical divergences on the limits of legitimate resistance, drawing on the distinctions between liberal and leftist perspectives as formulated by Brown and Halley in their critique of legal mobilization. We then analyze the repressive framings articulated in two key moments of institutional repression of the demonstrations: President Dilma Rousseff’s national address and the criminal proceedings known as the case of the “23 World Cup Prisoners.” We argue that these frameworks reflect a liberal conception of democracy, and that the disputes over the legitimacy of the 2013 protests reveal deeper tensions surrounding competing understandings of democracy in contemporary Brazil.

Resumo A resiliência e o empoderamento são dois construtos muito significativos que podem ajudar a entender a situação econômica em que as famílias brasileiras operam, especialmente na situação de crise e disparidades sistêmicas. O objetivo deste trabalho é, portanto, entender como esses construtos surgem na economia doméstica brasileira, tomando como caso o documentário Estou me guardando para quando o Carnaval chegar. Usando uma abordagem qualitativa e dedutiva, tentamos desvendar as estratégias de resiliência e os mecanismos de empoderamento que surgem ao longo do cotidiano das famílias. De fato, os resultados indicam que as famílias estão se envolvendo em práticas inovadoras e colaborativas como uma estratégia para superar adversidades e, consequentemente, aumentar seu próprio empoderamento. A ênfase final é o destaque à necessidade políticas públicas que incentivam o desenvolvimento socioeconômico.

Abstract Resilience and empowerment are two significant constructs that can help understand the economic situation in which Brazilian families operate, especially in the context of crises and systemic disparities. Therefore, the objective of this work is to understand how these constructs emerge in the domestic economy of Brazil, using the documentary Waiting for the Carnival as a case study. Through a qualitative and inductive approach, we seek to uncover the strategies and mechanisms of empowerment and resilience that emerge in the course of families' daily lives. Indeed, the results validate that families are actively engaged in innovative and collaborative practices as a strategy to withstand adversities and, consequently, gain empowerment. The final focus is the emphasis on the need for public policies that encourage socioeconomic development.

Resumo O artigo traz uma análise crítica da principal política pública de enfrentamento à violência política de gênero no Brasil, a Lei nº. 14192/2021. Para tanto, realizou-se um breve histórico da inserção do tema na agenda dos países latinoamericanos, seguido do exame do contexto de aprovação da lei brasileira e suas possíveis lacunas. Buscou-se, ainda, situar a análise crítica da Lei a partir das abordagens da interseccionalidade e da criminologia crítica e da mobilização do conceito de reengenharia do Estado no contexto neoliberal. O objetivo foi demonstrar que um olhar sobre o fenômeno necessita ser interseccional e a mera resposta penal, além de insuficiente, pode gerar efeitos reprodutores de desigualdades sociais, que em nada têm a ver com a luta por paridade de gênero na política.

Abstract This article presents a critical analysis of the main public policy to combat political gender-based violence in Brazil, Law nº 14192/2021. To this end, it provides a brief history of the issue on the agenda of Latin American countries, followed by an examination of the context in which this Brazilian law was approved and its possible gaps. The article also sought to situate the critical analysis of the Law based on the approaches of intersectionality and, critical criminology and the mobilization of the concept of state reengineering in the neoliberal context. The aim is to demonstrate that a look at the phenomenon must be inexorably intersectional and a merely penal response is insufficient and ineffective, and can generate effects that reproduce social inequalities, which has nothing to do with the fight for gender parity in politics.

Resumo Neste artigo, são elaboradas reflexões sobre a questão das energias renováveis a partir da obra do filósofo Enrique Dussel (1934-2023), sobretudo, a partir do projeto político de libertação. O objetivo é revelar como, através desse projeto, é possível construir aportes críticos para uma leitura sobre as energias renováveis, também chamadas de “energias limpas”. O caso empírico compreende as observações realizadas na Região Central do Rio Grande do Norte, através da chegada dos empreendimentos de energias renováveis e as consequências sobre os territórios rurais. Essa pesquisa tem um caráter descritivo e observacional, combinado com uma abordagem etnográfica.

Abstract In this article, some reflections on the issue of renewable energies are developed based on the work of the philosopher Enrique Dussel (1934-2023), particularly from the political project of liberation. The objective is to reveal how, through this project, it is possible to build critical contributions for a reading on renewable energies, also known as "clean energies." The empirical case comprises observations made in the Central Region of Rio Grande do Norte, through the arrival of renewable energy ventures and the consequences on the rural territories in the central region of the state. This research has a descriptive and observational character, combined with an ethnographic approach.

Resumo O feminicídio, assim como os demais crimes julgados pelo Tribunal do Júri no Brasil, deve ser decidido de acordo com a consciência dos jurados e os ditames da justiça. Essa margem de discricionariedade permite que os jurados não se limitem à lei e às provas ao decidirem. Contudo, pouco se sabe a respeito da dinâmica subjetiva desse tipo de processo decisório. Diante disso, o objetivo desta pesquisa foi compreender como os jurados decidiram casos de feminicídio, com base em como eles descreveram e explicaram a experiência de julgar no Tribunal do Júri. A pesquisa teve abordagem qualitativa, sendo empregadas como técnicas de produção de informações observações etnográficas e entrevistas semiestruturadas com jurados. Concluímos que, por serem sujeitos sociais, eles utilizam suas experiências de vida como guia para seus julgamentos. No contexto do júri, suas interações com outros participantes, principalmente com vítimas, réus e profissionais do direito, e o ambiente sociocultural mais amplo também desempenham um papel crucial na formação de suas decisões.

Abstract Femicide, like other crimes judged by the Jury Court in Brazil, must be decided according to the jurors' conscience and the dictates of justice. This margin of discretion allows jurors to go beyond the law and evidence when deciding. However, little is known about the subjective dynamics of this type of decision-making process. Therefore, the objective of this research was to understand how jurors decide femicide cases, based on how they describe and explain the experience of judging in the Jury Court. The research had a qualitative approach, using ethnographic observations and semi-structured interviews with jurors as information production techniques. We concluded that jurors, as social subjects, use their life experiences as a guide for their judgments. In the context of the jury, their interactions with other participants, mostly victims, defendants and legal professionals, and the broader sociocultural environment also play a crucial role in shaping their decisions.

Resumo Apresentamos uma análise jurídico-política da obra de Frantz Fanon (1925-1961) nos perguntando como aparece o direito nas contribuições teóricas de análise da realidade, particularmente do racismo e colonialismo, e nas formulações políticas da luta antirracista e anticolonial. Encontramos (i) crítica estrutural da relação histórica entre forma jurídica internacional e o processo de desumanização racial ontológica do colonialismo moderno; (ii) crítica das organizações de direito internacional como sendo “carta jurídica” do imperialismo usada quando a “carta da força bruta” não obtém os resultados esperados; (iii) uso político do direito para mobilização do opinião pública internacional e (iv) agitação político-pedagógica da causa da libertação nacional nas massas africanas revolucionárias.

Abstract We present a legal-political analysis of the work of Frantz Fanon (1925-1961), exploring how law appears in his theoretical contributions to the analysis of reality, particularly regarding racism and colonialism, as well as in his political formulations for anti-racist and anti-colonial struggles. We find: (i) a structural critique of the historical relationship between international legal forms and the ontological racial dehumanization inherent in modern colonialism; (ii) a critique of international legal organizations as being the "legal charter" of imperialism, used when the "charter of brute force" fails to achieve the desired outcomes; (iii) the political use of law to mobilize international public opinion; and (iv) the political-pedagogical agitation of the cause of national liberation among revolutionary African masses.

Utilizando uma abordagem interdisciplinar, análise de conteúdo e pesquisa participante, o estudo desvela as incongruências jurídicas e os impactos desmobilizadores, classistas e racistas da lei. Conclui-se que a legislação reforça a seletividade penal, marginalizando movimentos sociais e populares.

Abstract This article critically analyzes Law No. 16.139/2024 of Rio Grande do Sul from the perspective of Critical Criminology and the critical theory of human rights. Using an interdisciplinary approach, content analysis, and participatory research, the study reveals the legal inconsistencies and the demobilizing, classist, and racist impacts of the law. It concludes that the legislation reinforces penal selectivity, marginalizing social and popular movements.

Resumo O presente artigo é resultante de análise de alguns achados da pesquisa de mestrado realizado entre 2022-2025. Logo, ao objetivar refletir sobre o processo de implementação do Protocolo de Consulta Prévia à Comunidade do Quilombo de São José de Icatu-Mocajuba/Baião/Pará, buscou-se responder como a (não) implementação do Protocolo de Consulta Prévia afeta a comunidade remanescente de Quilombo de São José de Itacu? Para tanto, utilizou-se metodologicamente revisão bibliográfica e análise documental com abordagem qualitativa e método de estudo de caso de caráter exploratório. Ademais, utilizaram-se, ainda, registros in locu da comunidade e escrivências a partir de uma metodologia afrocentrada. Como principais resultados alcançados, observou-se que as principais barreiras para que o Protocolo seja executado na comunidade remanescente de Quilombo São José de Itacu encontra-se no fato de que mesmo com a implementação do Protocolo de Consulta Prévia e Consentimento Livre e Informado, aprovado na Comunidade do Quilombo de São José de Icatu em janeiro de 2023, os direitos ainda não são respeitados pelo poder público, incorrendo na necessidade de audiência pública frente à recusa das autoridades municipais em assinar um termo de compromisso com o Protocolo. Essa questão influencia diretamente na falta de políticas públicas, como, reforma de escola, igrejas, posto de saúde, por exemplo. Quanto ao mais, a não implementação atua para o avanço do agronegócio nas proximidades do quilombo de Icatu, pois acessam a comunidade sem respeitar o protocolo, sendo um risco para a existência continuada do território quilombola frente às catástrofes oriundas do desmatamento.

Abstract The present article aims to reflect on the process of implementing the Prior Consultation Protocol for the Quilombo Community of São José de Icatu-Mocajuba/Baião/Pará. In this context, the following central question was addressed: How does the (non-)implementation of the Prior Consultation Protocol actually impact the São José de Icatu Quilombo remnant community? The methodology employed included a literature review and document analysis, using a qualitative approach and an exploratory case study method. Additionally, in situ records from the community and writings based on an Afro-centered methodology were also used. The main findings reveal that the primary barriers to the execution of the Protocol in the São José de Icatu Quilombo remnant community lie in the fact that, even after the Prior Consultation and Free, Prior and Informed Consent Protocol was approved by the community in January 2023, their rights are still not respected. This has led to the need for a public hearing due to the refusal of local authorities to sign a commitment agreement with the Protocol. This issue directly influences the lack of public policies, such as the renovation of schools, churches, and health centers, for example. Moreover, the failure to implement the Protocol facilitates the expansion of agribusiness near the Icatu quilombo, as outsiders enter the community without respecting the protocol, posing a risk to the continued existence of the quilombola territory in the face of disasters caused by deforestation.

Resumo O artigo tem como objetivo geral reler a trajetória controvertida do poeta, escritor e expoente máximo do surrealismo francês, André Breton (1896-1966), no período entre 1917 e 1935. De modo específico, faremos essa releitura a partir de um fio condutor propriamente ético, ou seja, como a busca pela definição de um estilo de existência que combinaria, de modo singular, o binômio arte e revolta, herdado do século XIX. No interior dessa hipótese, pretendemos demonstrar, especificamente, que essa relação, em Breton, contém uma forte orientação anticínica, tendo como referência as aulas de Foucault sobre o cinismo na Antiguidade. Esse movimento é explicado por meio das controvérsias do poeta com o dadaísmo, a militância comunista e a obra de Antonin Artaud.

Abstract The article aims to revisit the controversial trajectory of the poet, writer, and leading figure of French surrealism, André Breton (1896-1966), during the period from 1917 to 1935. Specifically, this rereading is approached through an ethical lens, focusing on Breton’s search for a definition of a style of existence that uniquely combines the dual forces of art and revolt, inherited from the 19th century. Within this framework, we aim to demonstrate that this relationship in Breton contains a strong anticynical orientation, based on Michel Foucault's lectures on cynicism in Antiquity. This movement is explored through the poet's controversies with Dadaism, his communist militancy, and his confrontation with the work of Antonin Artaud.

Resumo A crise socioambiental contemporânea, intensificada pelo paradigma neoliberal e seus padrões insustentáveis de produção e consumo, representa um dos maiores desafios do presente, impondo limites à sustentabilidade planetária e aprofundando desigualdades sociais. Seus efeitos atingem de modo mais severo comunidades estruturalmente vulnerabilizadas, como povos indígenas, populações ribeirinhas e pescadores artesanais, que veem comprometidos direitos fundamentais relacionados à moradia, ao trabalho e à dignidade. Nesse contexto, torna-se imprescindível examinar o papel do Direito e da universidade pública na elaboração de respostas socialmente justas e ecologicamente responsáveis. O presente artigo analisa, sob essa perspectiva, a experiência do Projeto de Extensão Atendendo ao Povo das Águas, desenvolvido no âmbito do Programa Permanente de Extensão Cidadania, Direitos e Justiça da Universidade Federal do Rio Grande (CIDIJUS/FURG), em resposta ao desastre hidrológico ocorrido no Rio Grande do Sul em 2024. Com base em metodologia qualitativa, inspirada na pesquisa-ação, a investigação combina análise documental, bibliográfica e observação em campo, articulando teoria e prática na construção de conhecimento crítico. A partir da atuação extensionista e da prática do Escritório Modelo de Assessoria Jurídica (EMAJ) da FURG, busca-se demonstrar como a universidade pode constituir-se em espaço de resistência contra a naturalização das desigualdades, promovendo o acesso à justiça e a efetividade de direitos fundamentais em contextos de crise socioambiental.

Abstract The contemporary socio-environmental crisis, intensified by the neoliberal paradigm and its unsustainable patterns of production and consumption, represents one of the greatest challenges of our time, imposing limits on planetary sustainability and deepening social inequalities. Its effects disproportionately affect structurally vulnerable communities, such as Indigenous peoples, riverside populations, and small-scale fishers, whose fundamental rights related to housing, work, and dignity are severely compromised. In this context, it becomes essential to examine the role of Law and public universities in shaping socially just and ecologically responsible responses. This article analyzes, from this perspective, the experience of the Extension Project Atendendo ao Povo das Águas (“Serving the People of the Waters”), developed within the Permanent Extension Program Citizenship, Rights and Justice (CIDIJUS/FURG), as a response to the climate disaster that struck Rio Grande do Sul, Brazil, in 2024. Based on a qualitative methodology inspired by action-research, the study combines documentary and bibliographic analysis with field observation, articulating theory and practice in the construction of critical knowledge. Through the extensionist practice and the work carried out by the Legal Aid Clinic (EMAJ/FURG), the article seeks to demonstrate how the university can constitute a space of resistance against the naturalization of inequalities, promoting access to justice and the effectiveness of fundamental rights in contexts of socio-environmental crisis.

Resumo O presente artigo aborda as implicações da repatriação de objetos museais sob a perspectiva do método do direito comparado decolonial, proposto por Salaymeh e Michaels (2022). Neste trabalho, é tratado como o legado do colonialismo se manifesta nos museus, examinando o acúmulo de artefatos coloniais e a crescente demanda por sua repatriação a seus países de origem. Além da perspectiva do direito comparado decolonial, o artigo lança mão do método de natureza indutiva e exploratória, por meio do entendimento de temas ligados às ciências jurídicas e museologia, além de utilizar a pesquisa bibliográfica como elemento central, trazendo como ilustração o caso do Manto Tupinambá. Ao examinar este caso específico com base na teoria utilizada, o ensaio conclui e aponta para a necessidade de compreender as complexidades envolvidas na devolução de bens culturais, destacando a importância de uma abordagem decolonial para garantir justiça e equidade no tratamento dessas questões.

Abstract This article addresses the implications of the repatriation of museum objects from the perspective of the decolonial comparative law method proposed by Salaymeh and Michaels (2022). This paper addresses how the legacy of colonialism manifests itself in museums, examining the accumulation of colonial artifacts and the growing demand for their repatriation to their original countries. In addition to the perspective of decolonial comparative law, the article uses an inductive and exploratory method, through the understanding of themes related to legal sciences and museology, in addition to using bibliographical research as a central element, bringing as an illustration the case of the Tupinambá Cloak. By examining this specific case based on the theory used, the essay concludes and points to the need to understand the complexities involved in the return of cultural goods, highlighting the importance of a decolonial approach to ensure justice and equity in addressing these issues.

Resumo A Lei Maria da Penha (LMP) representa um marco no combate à violência doméstica no Brasil, alinhando-se a normativas internacionais como a CEDAW e a Convenção de Belém do Pará. Um de seus principais avanços é a previsão da competência híbrida, que permite às varas especializadas julgar tanto questões cíveis quanto criminais decorrentes da violência doméstica. No entanto, sua implementação tem sido marcada por resistências, especialmente por parte do Poder Judiciário, que frequentemente restringe essa competência a medidas protetivas de urgência, desconsiderando sua amplitude original. Este artigo analisa as disputas em torno da competência híbrida, utilizando a reescrita feminista como ferramenta analítica que evidencia as narrativas silenciadas nas decisões judiciais. Através da reescrita de um acórdão do Tribunal de Justiça de São Paulo, demonstra-se como a restrição da competência híbrida reforça a fragmentação do atendimento às mulheres, contrariando os princípios da LMP. Conclui-se que a reescrita feminista é uma estratégia poderosa para desconstruir narrativas hegemônicas e promover um sistema de justiça mais inclusivo e sensível às demandas das mulheres em situação de violência.

Abstract The Maria da Penha Law (LMP) represents a milestone in combating domestic violence in Brazil, aligning with international norms such as CEDAW and the Convention of Belém do Pará. One of its main advancements is the provision of hybrid jurisdiction, which allows specialized courts to judge both civil and criminal matters arising from domestic violence. However, its implementation has been marked by resistance, particularly from the Judiciary, which often restricts this jurisdiction to urgent protective measures, disregarding its original scope. This article analyzes the disputes surrounding hybrid jurisdiction, using feminist rewriting as an analytical tool to highlight silenced narratives in judicial decisions. Through the rewriting of a ruling by the São Paulo Court of Justice (TJSP), it demonstrates how the restriction of hybrid jurisdiction reinforces the fragmentation of services for women, contradicting the principles of the LMP. It concludes that feminist rewriting is a powerful strategy to deconstruct hegemonic narratives and promote a more inclusive and sensitive justice system to the demands of women in situations of violence.

Resumen Los derechos humanos son el paradigma del constitucionalismo moderno, sin embargo, Cuba los incorporó recién en 2019 lo que generó preguntas de cómo un sistema que se autodefina “socialista” sería impactado. Es así que, el principal objetivo del presente artículo es comprender por qué fueron incluidos y los posibles efectos en el sistema jurídico, político y social cubano. Para esto, nos apoyamos teóricamente en la Crítica Jurídica Marxista que por su arsenal conceptual permite hacer un análisis de la totalidad del problema plateado y no sólo se su dimensión jurídica. El texto está dividido en los siguientes apartados: marco teórico, metodología, antecedentes, derechos socialistas, la Constitución de 2019, de táctica a estrategia, de la legitimidad revolucionaria a la legitimidad legal y en las conclusiones. Por último, uno de los resultados al que se llegó es que los derechos humanos fungen como un termómetro de qué tanto el capitalismo se ha ido restaurando en la nación caribeña.

Yet, Cuba did not formally include them in its legal framework until 2019-a change that sparked questions about how a system that defines itself as “socialist” would respond to such an incorporation. The main goal of this article is to explore why these rights were included and what impact they may have on Cuba’s legal, political, and social order. The analysis draws on Marxist Legal Critique, whose conceptual tools make it possible to examine the issue in its full complexity, rather than limiting it to a purely legal perspective. The article is organized into several sections: theoretical framework, methodology, background, socialist rights, the 2019 Constitution, the shift from tactic to strategy, the transition from revolutionary legitimacy to legal legitimacy, and finally, the conclusions. Ultimately, one of the key findings is that human rights serve as a kind of thermometer, revealing the extent to which capitalism has been gradually restored within the Caribbean nation.

Resumo Em dezembro de 2023, o Supremo Tribunal Federal, ao julgar a Ação Direta de Inconstitucionalidade por Omissão nº 20, declarou a omissão inconstitucional do Congresso Nacional em regulamentar a licença-paternidade e fixou o prazo de 18 meses para sua normatização. Este artigo analisa o julgamento dessa ação à luz da teoria da identidade do sujeito constitucional de Michel Rosenfeld. Examina, em particular, como os instrumentos reconstrutivos da negação, metáfora e metonímia, tal como definidos pelo autor, operam na argumentação dos Ministros e promovem uma reelaboração constitucional da tradição. A partir dessa perspectiva teórico-metodológica, sustenta-se que a decisão da Corte tensiona e redefine, sob uma chave democrático-constitucional, concepções tradicionais de família, maternidade e paternidade. A análise evidencia que essa reconstrução se articula em torno de dois eixos argumentativos centrais: as transformações nas configurações familiares e as exigências contemporâneas de proteção à infância.

Abstract In December 2023, the Brazilian Supreme Federal Court, in adjudicating Direct Action of Unconstitutionality by Omission nº 20, declared the National Congress’s unconstitutional omission in regulating paternity leave and established an eighteen-month deadline for its normative implementation. This article analyzes the Court’s judgment through the lens of Michel Rosenfeld’s theory of the identity of the constitutional subject. It examines, in particular, how the reconstructive instruments of negation, metaphor, and metonymy, as defined by the author, operate in the Justices’ reasoning and promote a constitutional reworking of tradition. From this theoretical-methodological perspective, it is argued that the Court’s decision challenges and redefines, within a democratic-constitutional framework, traditional conceptions of family, motherhood, and fatherhood. The analysis shows that this reconstruction is articulated around two central argumentative axes: the transformations in family configurations and the contemporary demands for the protection of childhood.

Resumo Este estudo analisa 104 laudos de exame de corpo de delito de lesões corporais integrados ao processo criminal que apurou a conduta de policiais militares envolvidos no Massacre do Carandiru, ocorrido em 2 de outubro de 1992, no Pavilhão Nove da Casa de Detenção de São Paulo. Inserido no contexto de estudos sobre direito e violência de estado, o texto explora o que esses laudos revelam e ocultam sobre o Massacre e sua apuração, concentrando-se na coprodução médico-jurídica na investigação de casos que envolvem agentes estatais, utilizando os laudos de lesão corporal como objeto central de observação. A pesquisa apresenta contribuições em dois níveis: o primeiro diz respeito à prática de pesquisa, destacando a explicitação metodológica, os desafios éticos e o uso da ciência aberta na produção de memória. O segundo nível foca na compreensão dos acontecimentos, examinando o papel de múltiplos atores estatais com os sobreviventes do Massacre do Carandiru. O estudo também demonstra como normas, atos administrativos e instituições podem ser analisados como produtores de violência, responsabilização, reconhecimento e reparação dessas violências.

Abstract This study analyzes 104 forensic medical reports related to bodily injuries, integrated into the criminal process that investigates the conduct of military police officers involved in the Carandiru Massacre, which occurred on October 2, 1992, in Pavilion 9 of the São Paulo House of Detention. Situated within the context of studies on law and state violence, the text explores what these reports reveal and conceal about the Massacre and its investigation, focusing on the medico-legal coproduction in cases involving state agents, with the forensic reports serving as the central object of observation. The research aims two main contributions. The first concerns research practice, highlighting methodological clarification, ethical challenges, and the use of open science in producing memory. The second level focuses on understanding the events, examining the role of multiple state actors in relation to survivors of the Carandiru Massacre. The study also demonstrates how norms, administrative acts, and institutions can be analyzed as producers of violence, accountability, recognition, and reparation for these acts of violence.

Resumo O presente artigo analisará, à luz da hermenêutica jurídica e teoria do direito, a decisão do Tribunal Superior Eleitoral (TSE) no Agravo no Recurso Especial Eleitoral nº 0600122-97.2020.6.20.0033, quando a Corte cassou o mandato de uma mulher eleita sob o argumento de desvio na cota de gênero feminino na formação da nominata do partido político, prevista no art. 10, § 3º da Lei nº 9.504/1997 e, com isto, um homem tomou posse no cargo. Revelou-se que a decisão do TSE está em dissonância com o pensamento jurídico contemporâneo, aproximando-se do silogismo difundido na escolástica, aprofundando a desigualdade política de gênero.

Abstract This article will analyze, in the light of legal hermeneutics and legal theory, the decision of the Superior Electoral Court (TSE) in Appeal in Special Electoral Appeal nº 0600122-97.2020.6.20.0033, when the Court revoked the mandate of a woman elected under the argument of deviation in the female gender quota in the formation of the political party's nomination, provided for in art. 10, § 3 of Law No. 9,504/1997 and, with this, a man took office. It was revealed that the TSE's decision is in dissonance with contemporary legal hermeneutics, approaching the syllogism widespread in scholasticism, deepening political gender inequality.

Resumo O artigo descreve a trajetória de cinco instrumentos infralegais implementados pelo governo de Jair Bolsonaro entre 2020 e 2021, com vistas à regulação da economia do setor produtivo da cultura. O trabalho integra uma agenda de pesquisa mais ampla sobre os repertórios discursivos que fundamentam a gestão deste setor, interessada em investigar tanto os sentidos sobre a vida pública como as formas de governação e as novidades institucionais que são mobilizadas na pasta da cultura no Executivo Federal. Observa-se, no atual trabalho, como o mandato do ex-Presidente suscitou uma relação inusual entre os Poderes Executivo e Legislativo, desviando-se dos termos convencionais do chamado “presidencialismo de coalizão”. Construída em diálogo com a chave do infralegalismo autoritário, a análise revela uma sintonia com formas de governança da economia da cultura recentemente avançadas em diferentes países, e lança luz sobre estratégias de governamentalidade geradoras de quatro efeitos sobre as políticas públicas: agenda, retardo, controle e mobilização.

Abstract The article describes the course of five infra-legal mechanisms implemented by the Jair Bolsonaro administration between 2020 and 2021 to handle the economy of culture. The paper is part of a broader research agenda on the discursive repertoires grounding the management of this sector, which investigates the meanings of public life and the forms of governance and institutional innovations advanced by the Federal Executive. The current work observes how the former President's term gave rise to an unusual relationship between the Executive and the Legislative branches, deviating from the conventional terms of so-called “coalition presidentialism“. Inspired by the idea of authoritarian infralegalism, the analysis reveals a harmony with forms of governance of the economy of culture recently promoted in different countries. It also lights strategies of governmentality that generate four effects on public policies: agenda, delay, control, and mobilization.

Resumo Neste artigo, problematizo historicamente os debates sobre a jornada de trabalho na Subcomissão dos Direitos dos Trabalhadores e Funcionários Públicos (VII-A) e na Comissão da Ordem Social (VII), durante a Assembleia Nacional Constituinte de 1987-88 (ANC). Após apresentar a revisão da bibliografia sobre o tema, formulo uma narrativa historiográfica sobre o processo, evidenciando que, enquanto os constituintes ligados ao movimento sindical defendiam a redução da jornada semanal para 40 horas, os representantes do empresariado estavam firmes na manutenção das 48 horas então vigentes. Contudo, como aponto ao longo do artigo, as estratégias de tais agentes foram se alterando. Na conclusão, retomo os resultados alcançados na investigação e lanço hipóteses para futuras incursões no tema.

Abstract In this article, I problematize the debates on working hours in the Subcommission on Workers' and Civil Servants' Rights (VII-A) and the Social Order Commission (VII) during the Brazilian 1987-88 National Constituent Assembly (ANC). After presenting a review of the literature on the subject, I formulate a historiographical narrative of the process, showing that, while the constituents linked to the trade union movement advocated reducing the weekly working day to 40 hours, the representatives of the business community were firm in maintaining the 48 hours in force at the time. However, as I point out throughout the article, the strategies of these agents have changed. In conclusion, I return to the results of the investigation and put forward hypotheses for future research on the subject.

Resumo Este artigo analisa o leading case (RE 1323708) que será julgado pelo STF e trata se critérios geográficos e culturais devem ser considerados para a caracterização da redução da pessoa à condição análoga à escravidão. O problema enfrentado será: como a localização geográfica, objeto do leading case (RE 1323708), apaga a vítima camponesa do trabalho escravo? A hipótese sustentada é a de que o Poder Judiciário, nos julgamentos que utiliza como fundamento a localização geográfica, se pauta por uma visão estigmatizada do sujeito camponês escravizado, vítima da fronteira. Utilizará como principais referenciais teóricos Warat, Perelman e Foucault, realizando um estudo de base qualitativa, buscando levantar hipóteses interpretativas sobre os sentidos de cidadania camponesa que sustentam o argumento da localização geográfica. Como resultado apresentará a relação contraditória do Judiciário e a vítima camponesa. A principal conclusão é a compreensão de que o critério geográfico decorre da estigmatização e contribui para institucionalizá-la.

Abstract This article analyzes the leading case constituted by Special Appeal (RE) 1323708, which will be ruled upon by the Brazilian Supreme Court (STF) and is expected to be subject to widespread repercussion. The case will assess whether geographical and cultural criteria should be considered in determining whether an individual has been submitted to conditions analogous to slavery. The issue explored is: how does geographic location, the object of the leading case (RE 1323708), contribute to invisibilize the peasant victim of slave labor? The defended hypothesis is that the Judiciary, in judgments that use geographic location as a basis, is guided by a stigmatized view of the enslaved peasant subject, a victim of the frontier. The work of Warat, Perelman and Foucault are used as the main theoretical framework in the conduction of a qualitative study aimed at generating interpretative hypotheses regarding the meanings associated to peasant citizenship that support the geographic location argument. As a result, a contradictory relationship between the Judiciary and the peasant victim is identified. The main conclusion presented in this study involves an understanding that geographical criteria stem from a judicial vision that both hinges upon and helps to institutionalize the stigmatization of peasants.

Resumo Este estudo contribui para o desenvolvimento do direito de propriedade indígena decolonial, com foco no Commonwealth Caribenho. São usados três exemplos de não reconhecimento de títulos indígenas à terra: quanto aos Marrons jamaicanos, aos Maias de Toledo em Belize e aos Ameríndios na Guiana. Embora as três comunidades sejam muito distintas, a pesquisa comparativa decolonial demonstra que as questões que envolvem o título indígena são conceitualmente similares, transcendem as fronteiras do direito positivo e devem ser abordadas a partir de diversas abordagens metodológicas. O reconhecimento dos direitos territoriais indígenas transcende o domínio do direito de propriedade como um componente do direito privado e requer o envolvimento do direito constitucional, das normas de direitos humanos e do direito internacional. Essas disputas incluem temas de dinâmica de poder, legados coloniais, discriminação, luta social e resistência cultural. Incorporar as tradições jurídicas indígenas é central na jornada rumo à descolonização do direito de propriedade nessas sociedades.

Abstract This article proposes a decolonial approach to Indigenous property law in the Commonwealth Caribbean. The author presents three case-studies - Jamaican Maroons, Toledo Maya in Belize, and Amerindians in Guyana - highlighting how these communities’ claims to ancestral land transcend conventional property law categories and reveal the limitations of Western legal paradigms. The analysis demonstrates that Indigenous land rights are not adequately addressed within the private-law framework but instead require engagement with constitutional law, human rights law, international law, and Indigenous legal traditions themselves. The article explores how coloniality persists in judicial reasoning and state governance, even in post-independence contexts. Postcolonial states with Indigenous populations must reassess their views on these groups’ property rights and embrace innovative judicial and doctrinal methodologies. Only through such a decolonial shift can the region secure justice for Indigenous communities and transform property law into a vehicle of cultural survival and legal innovation.

Resumo A enfiteuse é um contrato de direito civil originário do direito romano, pelo qual um proprietário de terras (arrendador) arrenda terras sujeitas à conservação e ao pagamento de uma renda anual fixa por um arrendatário (enfiteuta). Neste artigo, traçarei uma história da enfiteuse na Itália. Primeiro, focarei nos debates historiográficos do século XIX sobre a enfiteuse. Em seguida, analisarei como os juristas coloniais italianos mobilizaram o feudalismo da enfiteuse para compreender e traduzir os sistemas jurídicos indígenas etíopes.

Abstract Emphyteusis is a type of civil law contract, originating in Roman law, whereby a landowner (lessor) leases land subject to its upkeep and the payment of a fixed annual rent by a lessee (emphyteuta). In this paper, I will trace a history of emphyteusis in Italy. First, I will focus on 19th century historiographic debates on emphyteusis. Second, I will look at how Italian colonial lawyers mobilized the feudalism of emphyteusis to understand and translate Ethiopian indigenous legal systems.

Abstract This article examines the relationship between decoloniality and judicial reasoning through an investigation of how the trauma of dispossession shapes the way post-colonial legal decision-makers (i.e., judges) understand and create a pluralistic approach to property law in Indonesia. Through a decolonial comparative law lens, it is claimed that decolonizing property law is essentially construed upon the images of spatiotemporal configuration of post-colonial lived experience.

Abstract This research has the purpose of developing a decolonial comparative analysis of collective property law and the cultural-territorial dynamics of two indigenous peoples: Xukuru de Ororubá, in Brazil, and Mapuche in Chile, through the translation of the concept of collective property to territorial identity. The research shows how decolonial comparative law can take advantage of neo-institutional analysis to promote an intercultural dialogue.
