Open-access Between Criminalization and Popular Resistance: Law No. 16,139/2024 and the Experience with the MTST in Rio Grande do Sul

This article critically analyzes Law No. 16.139/2024 of Rio Grande do Sul from the perspective of Critical Criminology and the critical theory of human rights. Using an interdisciplinary approach, content analysis, and participatory research, the study reveals the legal inconsistencies and the demobilizing, classist, and racist impacts of the law. It concludes that the legislation reinforces penal selectivity, marginalizing social and popular movements.
