Examinam-se as relações entre democracia e justiça na teoria política contemporânea. Após evidenciar as insuficiências da vertente competitiva da democracia com respeito a esse tópico, argumenta-se que necessitamos recorrer a uma concepção "epistêmica" de democracia deliberativa, para a qual há um padrão independente de legitimidade política com base no qual os resultados de procedimentos deliberativos devem ser avaliados. Os limites dessa concepção epistêmica, sobretudo no que se refere ao lugar que nela deve ser reservado à competição e ao conflito políticos, são discutidos.

Abstract in English:

The relations between democracy and justice in contemporary political theory are examined. The shortcomings of the competitive tradition of democracy on this score are brought out, and it is argued that we need an "epistemic" conception of deliberative democracy, according to which an independent criterion of political legitimacy should be employed in evaluating the outcomes of deliberative procedures. The limits of such an epistemic conception, particularly with reference to political conflict and competition, are discussed.

Diferentes propostas de reintrodução da escolha por sorteio como forma de preencher funções políticas são estudadas. A seleção aleatória de legisladores ou governantes reduziria o impacto do poder econômico, permitiria uma representação mais fidedigna de grupos minoritários ou desprovidos de recursos políticos e promoveria o rodízio entre governantes e governados, impedindo a cristalização de uma elite oligárquica. No entanto, haveria perda de continuidade legislativa e, em especial, de responsividade dos governantes em relação aos governados. Apesar de suas debilidades, as propostas são úteis como forma de compreender os problemas da representação eleitoral e identificar suas causas.

Different proposals for the reintroduction of choice by lot as a way of performing political functions are studied. Selecting legislative or governing positions by chance would reduce the impact of economic power, would allow a more trustworthy representation of minority groups, and would prevent the rise of an oligarchy. However, there would occur a loss of legislative continuity and, specially, of accountability of the governing towards the governed. Despite their weak points those proposals are useful for a better understanding of the problems of electoral representation and for detecting their causes.

A partir de uma análise crítica da teoria econômica da democracia de Downs, examinam-se, em termos do problema da "seleção adversa" de Ackerlof, os efeitos da assimetria de informação entre candidatos (com taxas diferentes de demagogia) e eleitores (com níveis diferentes de conhecimento), contra o pano de fundo da relação entre divisão de trabalho e democracia.

On the basis of an analysis of Downs' economic theory of democracy the effects of information asymmetry between candidates (with different demagogy rates) and electors (with different knowledge rates) are examined in terms of Ackerlof 's "adverse selection" problem and against the background of the relationship between division of labour and democracy.

Argumenta-se que as análises de regime e os estudos culturais são abordagens excludentes ao estudo dos processos de democratização, embora apresentem interfaces acerca de certos dilemas teórico-históricos principais (tais como a questão do clientelismo, a da conceituação normativa da democracia, os atores sócio-políticos relevantes, a unidade e o nível de análise) que revelam as limitações internas de ambas, como desafios a uma abordagem empírica e conceptual mais abrangente dos processos de democratização.

Regime analyses and cultural studies are exclusionary approaches to the study of democratization but they present thematic interfaces on theoretical and historical problems. Such are the issues of clieritelism and of the normative concept of democracy, the relevant sociopolitical actors, the level and unit of analysis, etc - which both approaches face differently. This article reviews these differences, and maintains that they reveal the internal limitations and unsolved theoretical problems of both approaches, as challenges for a more comprehensive theoretical and empirical approach to democratization.
