Open-access Reproductive justice and intersectionality: an analysis of the Criola and Redes da Maré amici curiae memorial petitions to the Brazilian Supreme Court

This article analyses the briefs presented by Criola and Redes da Maré in the Arguments for Failure to Comply with a Fundamental Precept 442 and 989, currently before the Supreme Court (STF). With the aim of showing how these associations have approached the intersectional perspective in the debate on reproductive rights, the first theme analyses the narratives constructed in twenty years of judicialisation of abortion in the STF, and the second examines the articulation of an intersectional approach in these memorials. The methodology includes a socio-legal literature review on intersectionality and reproductive justice, a qualitative analysis of the content of the memorials, and data from a mapping of constitutional control measures on abortion. The results show the importance of intersectionality for access to legal abortion and for overcoming the unconstitutional state of affairs in the public health system.
